These terms apply to the websites operated by Lifeline Health, including lifelinehealth.org and lifelinehealthfl.org, and any related pages, forms, or services we provide (collectively, the “Websites”). In these documents, “Lifeline Health,” “we,” “us,” and “our” mean Lifeline Health and its affiliated programs, including Lifeline Health Florida. “You” and “user” mean any person who accesses or uses the Websites.
Lifeline Health is a nonprofit public health organization. We provide community-based testing, treatment, prevention, and patient support services for Hepatitis C, HIV, and other sexually transmitted infections.
TERMS OF USE
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE WEBSITES OR OUR SERVICES. BY ACCESSING OR USING THE WEBSITES, YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT AGREE, DO NOT USE THE WEBSITES.
We may update these Terms of Use at any time. Continued use of the Websites after changes are posted means you accept the updated terms. The “Last Updated” date above reflects the most recent version.
1. NOT MEDICAL ADVICE; NO PROVIDER-PATIENT RELATIONSHIP
The content on the Websites, including text, graphics, images, videos, and information from Lifeline Health and its partners (“Content”), is provided for general informational and educational purposes only. The Content reflects evidence-based public health practices but is not a substitute for professional medical advice, diagnosis, or treatment.
Using the Websites, reading the Content, or contacting us through the Websites does not create a provider-patient relationship. A provider-patient relationship is formed only when you are evaluated and accepted for care by a Lifeline Health clinician or partner provider through our intake process.
Always seek the advice of a qualified healthcare professional regarding any medical or behavioral health condition. Never disregard professional advice or delay seeking it because of something you read on the Websites.
2. EMERGENCIES AND CRISIS SUPPORT
THE WEBSITES AND OUR HELPLINE ARE NOT EMERGENCY SERVICES.
If you are experiencing a medical emergency, call 911 immediately. If you are experiencing a mental health or suicidal crisis, call or text 988 (the Suicide and Crisis Lifeline).
Our helpline at (888) 202-6052 offers information and support and is staffed to assist with questions about testing, treatment, and resources. It is not a substitute for emergency care.
3. CHILDREN’S PRIVACY
We are committed to protecting the privacy of children. The Websites are intended for a general adult audience and are not designed to attract children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us so we can remove it.
4. PROTECTED HEALTH INFORMATION AND PRIVACY
Some areas of the Websites allow you to submit personal or health-related information, such as appointment requests and contact forms.
Information submitted through our secure intake and appointment request forms is transmitted through HIPAA-compliant third-party service providers and handled in accordance with applicable privacy and security laws, including HIPAA where applicable.
Please do not transmit sensitive health information through unsecured email or social media. Use only the secure forms we provide. Our Privacy Policy and Notice of Privacy Practices govern how we collect, use, and protect your information and are incorporated into these Terms of Use by reference.
5. NO-COST SERVICES AND ELIGIBILITY
Many Lifeline Health services are offered at no cost to eligible individuals. Eligibility may depend on clinical, insurance, funding, residency, or program criteria, and may change over time. Information on the Websites describing services, availability, or cost does not guarantee that any particular service will be available to you. Final eligibility is determined through our intake and clinical review process.
We do not guarantee any specific health outcome. Statements about treatment effectiveness, including cure rates, reflect general clinical data and individual results may vary.
6. USE OF CONTENT AND INTELLECTUAL PROPERTY
The Content on the Websites is owned by or licensed to Lifeline Health and is protected by United States and international copyright, trademark, and other laws. We authorize you to view and download a single copy of Content for your personal, non-commercial use only.
You may not copy, reproduce, republish, distribute, modify, or create derivative works from the Content without our prior written consent, except as necessary to browse the Websites or to print a single copy for personal reference. The Lifeline Health name and logo are trademarks of Lifeline Health and may not be used without permission. All rights not expressly granted are reserved.
If you violate these Terms of Use, your permission to use the Content automatically ends and you must destroy any copies you have made.
7. USER SUBMISSIONS AND COMMUNICATIONS
You agree not to submit or transmit, through any form, email address, or feature on the Websites, any content that is unlawful, infringing, defamatory, harassing, abusive, or that violates the rights of any party or any applicable law. You are responsible for the content you submit and for ensuring you have the right to submit it.
Except for personal and health information governed by our Privacy Policy and Notice of Privacy Practices, any general business idea, suggestion, or comment you submit to us is considered non-confidential, and you grant Lifeline Health a non-exclusive, royalty-free, worldwide license to use it without obligation to you. If you wish to keep an idea confidential, do not submit it through the Websites.
We try to respond to inquiries promptly but cannot guarantee a response to every message.
8. ACCOUNTS, PORTALS, AND PASSWORDS
If we provide you access to a patient portal, scheduling tool, or other secured area, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Do not share your password. Notify us promptly if you believe your account has been accessed without authorization. We are not responsible for losses resulting from unauthorized use of your credentials caused by your failure to safeguard them.
9. THIRD-PARTY LINKS AND RESOURCES
The Websites may include links to third-party websites, resources, or services for your convenience. We do not control, endorse, or assume responsibility for the content, accuracy, or practices of any third-party site. Your use of third-party websites is at your own risk and subject to their terms and privacy policies.
10. DISCLAIMER OF WARRANTIES
The Websites and the Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Lifeline Health and its officers, directors, employees, agents, licensors, and suppliers disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no representation or warranty that the Content is accurate, complete, current, reliable, or error-free, or that the Websites are free of viruses or other harmful components.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Lifeline Health and its officers, directors, employees, agents, licensors, and suppliers will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of or inability to use the Websites or the Content, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages.
Any claim arising in connection with your use of the Websites must be brought within one (1) year of the event giving rise to the claim. The remedies available to you are limited to those expressly stated in these Terms of Use.
12. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Lifeline Health and its officers, directors, employees, agents, licensors, and suppliers from any claims, liabilities, damages, and expenses, including reasonable legal fees, arising from or related to your violation of these Terms of Use or your misuse of the Websites.
13. GOVERNING LAW AND JURISDICTION
These Terms of Use are governed by the laws of the State of Florida, without regard to its conflict of laws principles. You agree that any dispute relating to your use of the Websites will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
If you access the Websites from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. We make no representation that the Content is appropriate or available for use outside the United States.
14. GENERAL PROVISIONS
If any provision of these Terms of Use is found invalid, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of that provision. The sections on Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law survive termination of these Terms of Use. These Terms of Use, together with our Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and Lifeline Health regarding the Websites.
DISCLAIMER
The information provided by Lifeline Health on the Websites is offered free of charge to users, on the condition that users agree to be bound by the terms set out here. We may update this Disclaimer at any time, and you agree to the most recent version each time you use the Websites. Do not use the Websites if you do not agree.
- The information on the Websites is provided “as is” for general information only. It is not intended to provide medical, behavioral health, or public health advice and should not be relied upon as a substitute for consultation with a qualified healthcare professional familiar with your individual condition.
- You agree to hold harmless Lifeline Health and its directors, officers, employees, and agents from all claims arising out of or related to your access to or use of, or inability to use, the Websites or the information they contain.
- Opinions and recommendations expressed in third-party content, testimonials, or linked materials are not necessarily those of Lifeline Health and are not endorsed by us.
